Artificial intelligence (AI) has the ability to transform healthcare for the benefit of both healthcare providers and patients. Implementing a framework that facilitates the (re-)use of data is pivotal to its advancement.

However, the development and deployment of AI face various challenges. This study outlines some of the AI technologies applied in the healthcare sector, examines essential EU legal frameworks facilitating the (re-)use of data for the development of medical AI, and discusses some of the key concerns arising in this context. Finally, it presents policy recommendations to address these issues. This document was provided by the Policy Department for Transformation, Innovation and Health at the request of the SANT Committee.

The objective of this paper is to provide insight into the current challenges and opportunities related to policies aimed at:

• Enhancing data-driven patient care;
• Strengthening the protection of health data systems; and
• Promoting responsible AI adoption in healthcare.

To start, this paper will explore the AI technologies currently deployed or available in healthcare across the EU.
